Terms of Service

The legal agreement between you and Fuvio for use of our app, website, and services.

By creating an account or using the Fuvio mobile application or related services ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

  • You must be at least 18 years old
  • You must have legal capacity to enter binding contracts in your jurisdiction
  • You must not be barred from receiving the Service under applicable law
  • You must not be on any government sanctions list

2. Account Registration

You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorized use at [email protected].

3. Virtual Items & Currency (Vio-Gems)

  • Vio-Gems are virtual currency purchased with real money
  • Vio-Gems have NO monetary value, NO cash equivalence, and CANNOT be redeemed for cash by ordinary users
  • Vio-Gems are NON-TRANSFERABLE except as gifts within the Service
  • Vio-Gems are NON-REFUNDABLE except as required by law (see Refund Policy)
  • Vio-Gems may EXPIRE if your account is inactive for 12 consecutive months
  • Hosts/agencies who earn Bean-Vios may request withdrawal subject to KYC verification and minimum thresholds
  • We reserve the right to modify the value, supply, or availability of virtual items at any time

4. Host & Creator Earnings

  • Hosts retain a percentage of gift revenue per the published commission schedule (currently 45-60%)
  • Agency members may share revenue with their agency owner per agency settings
  • Withdrawals are processed weekly upon reaching the minimum threshold
  • Hosts must complete KYC verification before first withdrawal
  • Hosts are independent contractors, not employees of Fuvio
  • Hosts are responsible for their own taxes

5. User Conduct

You may NOT use the Service to:

  • Stream nudity, sexually explicit content, or solicit prostitution
  • Stream violence, self-harm, suicide, illegal drugs, or weapons sales
  • Harass, threaten, defame, or impersonate others
  • Post content that promotes hate, discrimination, or terrorism
  • Stream copyrighted content without permission
  • Spam, scam, phish, or solicit personal information from other users
  • Use bots, scripts, or automated systems
  • Reverse engineer, decompile, or modify the app
  • Bypass age verification or use false identity documents
  • Engage in money laundering, tax evasion, or other financial crimes
  • Violate any applicable law or regulation

Violations may result in warning, content removal, gift/coin reversal, account suspension, permanent ban, and/or legal action.

6. Content License

You retain ownership of content you upload, but you grant Fuvio a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute, and adapt your content for Service operation, promotion, and improvement. You represent that you have the right to grant this license.

7. Intellectual Property

The Fuvio app, brand, logos, gift designs, animations, and other proprietary content are owned by Fuvio and protected by copyright and trademark law. You may not copy, modify, or use them without written permission.

8. Third-Party Services

The Service integrates third-party services (LiveKit, Stripe, Firebase, etc.). Your use of those services is governed by their respective terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE. WE ARE NOT RESPONSIBLE FOR USER-GENERATED CONTENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUVIO IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

11. Indemnification

You agree to indemnify Fuvio against claims arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time via Settings → Account → Delete Account.

13. Dispute Resolution

Disputes shall be resolved by binding arbitration administered by [arbitration body, e.g., SIAC for Singapore]. You waive your right to participate in class actions. This clause does not apply where prohibited by law (e.g., consumer protection rights in EU/UK).

14. Governing Law

These Terms are governed by the laws of [jurisdiction — to be specified], without regard to conflict of law principles.

15. Apple App Store Additional Terms

If you downloaded the Service from the Apple App Store: Apple is not a party to these Terms. Apple has no obligation to provide maintenance or support. In case of failure to conform to warranties, you may notify Apple for refund. Apple is a third-party beneficiary of these Terms.

16. Changes to These Terms

We will notify you of material changes via in-app notification at least 30 days before they take effect. Continued use after changes constitutes acceptance.
